“What About Bob” Vs. “A Beautiful Mind”

Comparison Paper Watching these two movies, â€Å"What about Bob? † And â€Å"A Beautiful Mind† really opens your eyes to problems that many people In our world face throughout their daily lives. These movies provide us with an opportunity to become better acquainted with the reality of disorders and help us realize that real people do struggle with these issues and that these issues can affect the person themselves or their family or even their psychiatrist. But what we also can learn from these movies is that everyone, even people with disorders, can contribute good things to the world around them. In â€Å"A Beautiful Mind,† John Nash Is a smart man who soon develops schizophrenia. His schizophrenia consists of seeing people and believing people are out to get him. His schizophrenia becomes so bad that it burdens his wife and friends. It becomes difficult for his wife to love him and she is uncomfortable around him. At one point in the movie, his delusions caus e him to almost drown his baby and cause him to knock his wife on the ground.John Nash, after going to a mental hospital, and seeing a therapist, still had bad delusions, but, he was so smart that he himself figured out owe to Ignore his delusions and continue on with life semi-normally. Although Nash still has schizophrenia he is still super intelligent and uses his intelligence too help the world around him. Nash goes on to win the Nobel Memorial Prize in Economics for his work on game theory, which helps with economics, political science, and psychology, as well as logic and biology. The Nobel Prize is an award for outstanding contributions to the field of economics, generally regarded as the most prestigious award for that field. Receiving this award proves that even though Nash has a reverie disorder he Is still able to contribute a lot to the world around him. John Nash also contributes his knowledge to young college students. Nash, after figuring out how to control his delusio ns began again working at Princeton university as a professor. Being a professor at an Ivy League school like Princeton is a pretty admirable accomplishment.Teaching college at the Ivy League level is definitely contributing to the world around him, because, not only is he teaching the younger generation, he Is teaching some of the smartest people in the world. Now, because of Nash these students can go into the real world having learned very valuable information. Lastly, John Nash contributed something good to a very close part of his world. John Nash was married and his wife loved him very much. Although his schizophrenia was a burden to his wife and the love between them, she still loved him very much and wanted to be with him.He gave his wife love, which, I think Is the best thing you can give to someone. In â€Å"What About Bob? † Bob Wiley Is a man with separation anxiety disorder and many phobias. Because of these problems, Bob, is always apprehensive and in a state of panic. Bob is a very difficult client for therapists because he becomes so attached to people. He drove away his first therapist and caused his second one, Dry. Marvin, to go insane. Although Bob is annoying to be around and causes problems for some people, he also helps people Marvin tried numerous times to teach Saggy how to dive into the lake but he was unsuccessful.Bob tried to teach Saggy how to dive and he was successful. While trying to teach him how to dive, Bob realized that he is afraid of docks and water and diving into the water. Bobs fears make Saggy want to teach him that it's not that scary. So while showing Bob how to dive, Saggy Inadvertently teaches himself to not be scared and he couldn't have done it without Bob. Bob also brought Joy to Dry. Margin's family. Although, Dry. Marvin was not very fond of Bob, Bob made the Marvin family happy and helped them to really enjoy their vacation because of his personality. He brought Joy to them because they all came togethe r and kind of took Bob in and took care of him; he was like another child in the family. Dry. Margin's wife enjoyed Bob's resend so much that she invited him to stay for dinner and then sleepover their house one night. Dry. Margin's daughter also enjoyed Bob's presence so much that she invited him to hangout with her and her friends on their sailboat. Despite Mr.. Marvin hating him, Bob helps him in a few ways. The first way Bob helps Dry. Marvin is during dinner one night. Dry. Marvin is choking on food and Bob saves him by giving him the Heimlich.Although this really has nothing to do with Bob's disorder it still shows that he can do good things for the people around him. Bob also helped Dry. Marvin with his interview on Good Morning America. Bob was originally not supposed to be in the interview but because of his attachment to Dry. Marvin he got himself on the show. At first Dry. Marvin thought that this was an awful idea but soon that proved to be wrong. Dry. Marvin froze up an d didn't know what to say while Bob, posing as Dry. Margin's patient, talks very highly of the Dry. Margin's book and talks about how good of a therapist he is. Bob's presence on this show really helped Dry.Marvin look really good to everyone. Both of these movies present us with characters that have pretty severe disorders in their respective spectrums of severity. These movies show us how their disorders really make daily life difficult for them and others surrounding them. While showing the bad sides of their disorders these movies also show their good sides and what they can offer to the world and everyone around them. I have grown up with and around people with disorders and disabilities and I know for a fact that each person, even with a disorder, can contribute something special and unique to the world.

1984 – Technology in Todays Soceity

Not many people are fans of being excessively supervised and observed. From an 11 year old boy being observed in the park by his grandparents, to a student sitting in class being observed by the teacher during examination. Knowing that you are constantly under surveillance can be very intimidating. Right through history, the intensity of government regulations have altered from low down to sky-scraping. The novel 1984, written by George Orwell consistent of a very dictatorial government. In this fictional commentary novel, George Orwell predicts the future where technology and the power given to the government will reduce privacy in everyone’s day to day life. Today’s society is majorly impacted by the rapid development of technology; in the novel George Orwell had used technology as an example of lack of privacy. To begin with, our advanced technology has reached such an extent that it is very straightforward for the government to figure out everything about us from our past including, our previous vacation, were we live, where we attended school or even last time we made a purchase through our debit or credit. To gain access into a person’s life the government has issued every citizen a social insurance number, this card contains a person’s entire record of everything that they have done in the country. This is related to what George Orwell had expressed in his novel, the government in the novel is being referred to the big brother. In the novel the big brother kept watch over every step that was done by the humans, there was even a sign which said â€Å"big brother is watching you,† this is the same as our government now since most things we do are being watched or even listened to. Another example of this would be the use of telescreens in the novel. The telescreens previewed everybody’s room in the building; therefore if any movement or discussion going on will not be private, â€Å"Any sound Winston made, above the level of a very low whisper, would be picked up by it†. This is now similar to today’s surveillance cameras; although this novel was written in 1948 the first surveillance camera had been invented in 1965. Since then the world had become more advanced than ever before. Cameras are now put up almost everywhere in; business offices, convenience store, apartment buildings, intersections, even all age schools. In the novel the author essentially points out that the future will hold no privacy and telescreens. phone calls, emails, texting are examples of telescreens since they can be accessed by the government authorities anytime. In conclusion, the novel 1984, is a fiction although what George Orwell tried illustrating was us humans are going head over heel with technology which is giving the government power. Some events that occurred in his novel have actually accrued and while he was writing this novel it was all a prediction for the future because some things he mentioned did not exist in that time period.

Human Resource Management Roles/Hcs 341

Human Resource Management Roles Human Resource Management (HRM) is the function within an organization that focuses on recruitment of, management of, and providing direction for the people who work in the organization. Human Resource Management can also be performed by line managers (Heathfield, S. M. ). Human Resource Management is the organizational function that deals with issues related to people such as compensation, hiring, performance management, organization development, safety, wellness, benefits, employee motivation, communication, administration, and training. Human Resource Management is also a strategic and comprehensive approach to managing people and the workplace culture and environment. Effective HRM enables employees to contribute effectively and productively to the overall company direction and the accomplishment of the organization's goals and objectives (Heathfield, S. M. ). Planning Human resources managers try to project how many employees will be necessary. They look at how many good workers are staying with the company and how many leave. Ideally, they want a low turnover ratio, where more people are staying than leaving. Planners try to identify good workers from the applicant pool, and use them to replace people leaving the company. The ultimate goal is to increase highly skilled and experienced personnel each time there is turnover. If a company is going to reduce employee numbers, planning tries to look for positions that could be trimmed without harming the company. Pay People in human resources management keep updated on pay and employee tax laws. They negotiate salary and wages with an applicant as well as bonuses, merit-based awards and commissions. Other pay areas they work with include retirement, life insurance, health insurance, vacation time, sick leave, disability insurance and stock ownership plans (Felix, J. ) Training Human resources personnel coordinate employee orientation; new hires learn their rights, responsibilities and the company's physical and organizational structures. Training and development builds new hires into proficient workers. As employees gain experience, they receive supervisor, management and leadership trainings. Training happens both on the job and in formal classroom instruction. Employees can end up at a leadership or management academy outside their company (Felix, J. ) Laws and Regulations Employees receive manuals and handbooks as soon after they're hired. These books contain the company's laws affecting the employee; and the company's expectations for the employee. Human resources personnel review and process firing requests, as some states make it hard to easily fire an employee. Some states are â€Å"at will† employment states; employers can terminate employment for any reason. The employee can also quit for any reason. Human resources personnel coordinate ethics training and enforcement. They hold this kind of training to reduce business fraud, mismanagement, and insensitivity toward other cultures, races, religion and gender (Felix, J. ) Wellness The Human Resources department coordinates wellness programs such as drugs, diet, exercises, health, ergonomics, diversity, spirituality and employee harmony. Reducing mishaps in the workplace, and reducing diet and habit-based sickness, helps improve productivity. An organization has to pay worker compensation and health insurance. Wellness programs reduce sickness and injury in the long run, saving the company money while getting more out of the worker (Felix, J. ) In conclusion, human resource management is very vital in any job field that you go to. Human resources are forever changing as we develop new technology, new laws and regulations, new innovative ways to deal with employees, health and wellness, etc. The greatest future challenge for the field will be the continued integration of management with other theories to address socially relevant issues as life becomes more complex and diverse. Week 6 post class 6310 Assignment Example | Topics and Well Written Essays - 250 words

Week 6 post class 6310 - Assignment Example Having had previous experience with a foreign nurse who did not fit the requirements needed is enough justification to take caution and act the way you are proposing to take and I would also make the same judgments and decisions (Billings and Halstead, 2012). I agree with your suggestions about the importance of the nurse being culturally sensitive and especially so because the Asian may take offense when the nurse suggests a change of diet. Since the Asian has also high academic achievements more than the nurse, it may be better if the nurse takes a smoother approach with a soft tone and not an assertive one that can be taken as an offense (Bradshaw, 2011). The approach you suggest of following the code of ethical conduct for recruitment of foreign-educated health professionals to the United States is very noble and unique one. This action will ensure that whatever decisions you will make about orienting the foreign nurse will not harm the nurse or enforce biasness and especially on cultural orientation (Alliance for Ethical International Recruitment Practices, 2012). Ambient music Essay Example | Topics and Well Written Essays - 1750 words

Ambient music - Essay Example This "Ambient music" essay outlines types of ambient music and peculiarities of this genre. This is what Ambient Music is all about. Ambient music is so diverse because it has borrowed extensively from many different cultures. Music is described as "the science or art of incorporating pleasing, expressive or intelligible combinations of vocal and instrumental tones into a composition having definite structure and continuity," or it is otherwise said to be "Vocal or instrumental sounds having rhythm, melody or harmony." (Webster’s dictionary, 3rd New International Dictionary of the English Language) Therefore Ambient Music is a conglomeration of a wide range of rhythm and sounds which have been incorporated to make it richer and more diverse. Webster’s definition of â€Å"Ambient† is "to go around, surround, encompass. An encompassing environment or atmosphere" (Webster’s Dictionary) Ambient music uses other fractal sounds such as the rush of wind, the fall of waves or a waterfall, the rustling of leaves, the sound of birds, the hissing of a snake, the sound of an airplane, or the sound of rain. Therefore it cannot be categorized in a clear cut manner because of its diversity. Different kinds of ambience need different kinds of sounds and music in order to cater effectively or suit the atmosphere where it is played. This type of ambient uses the synthesizer a lot creating a kind of dreamlike or ethereal drifting feeling which is very soothing and lends a peaceful mood to the person who is listening.

Reward management and performance related pay Essay

Reward management and performance related pay - Essay Example In today's fast-paced modern world, the job market seems to be getting more and more diverse, wide and inclusive of a great number of potential factors, that could affect the way one sees his job. Human Resources Management is one such area that is gaining importance by the day. Human Resources Managers work towards the fundamental problem of creating a balance between the expectations of both, employers and employees. The job market is getting highly competitive and retaining good talent is becoming an arduous task, owing to the better attractive offers being offered to talented workforces. As they say, grass on the other side of the fence is greener and therefore, employees find themselves being pulled across by alluring competitors. Under such circumstances, the compensation or pay packet goes a long way in determining the loyalties of employees. For instance, if the talented employee in question is unsatisfied with the compensation he receives from his current job, he would obviou sly consider the competitor's job that offers him greater potential and pay. Most employees prefer jobs that offer challenges and on successful dealing and completion of these challenges, would prefer better pay packets. At the end of the day, pay is a huge motivator or factor in diminishing quality of output. Therefore, jobs that offer growth potential, in terms of the hierarchical setup and the pay raise, experience great amount of success in maintaining stability in terms of employee retention and in cementing employer-employee relationships. "..the pay package is one of the most obvious & visible exchanges of the employment relationship; it is the main issue in the exchange between employer & employee, expressing the connection between the labour market, the individual's work & the performance of the employing organisation itself" (Hegewisch, 1991: 28). Therefore, the solution to this problem faced by employers in the process of reducing employee attrition rates and retaining talent, is performance-related payments and issuing rewards for quality output of work! Objectives of Employer and Employee In an organisation, both the employers, as well as, the employees possess varied objectives and expectations from each other, the job and the outcome. The objectives of the employer varies significantly from that of the employee, in formulating and pursuing the mutual contract. Here are the objectives of the employer, when he formulates and enters into a payment contract with his employee: Detainment: Employers look towards retaining the talent they spot in employees, without allowing competitors to take over the same. Therefore, they endeavour to satisfy their talented employees by formulating and putting forth a good payment contract. No one would want to lose a good employee due to under-payment levels. Thus, one of their many objectives is to retain talent and reducing the attrition rates. Steer clear: Employers attempt to steer clear of competitors and emerge victorious in alluring and maintaining some of the most skilful talent, which directly affects the positive quality of work output. Thus, they look to maintain an upper hand amongst competitors, by entering into a decent payment contract with their employees. Intelligent dealings: Employers try to attract the best possible talent within their limitations in providing payment. When they enter into the payment contract, they attempt to make the most in terms of attracting the best

Assignment about ethics Example | Topics and Well Written Essays - 1000 words

About ethics - Assignment Example System 1 thinking is characterized by an unconscious and automatic way of thinking. This system has the universal cognition that occurs both in human beings and in animals, an aspect that is considered evolutionary. System one thinking is comprised of subsystems that work hand-in-hand within the same autonomy. System 1 thinking is responsible for instinctive behaviors that are programmed inherently. This system solves problems through the dependence of prior information that is associated with the system including automatic, holistic and fast cognitive ability (Kaufman & Singer, 2012). System 2 is recent compared to system 1. This system is characteristic of human beings only. This system is also understood as the explicit and rule-based system. It is slow, sequential, and domain-general and is performed in the central memory system. System 2 allows abstract hypothetical thinking that does not happen in system 1. This system functions with regard to logical standards and is rule based, demanding, analytic and controlled of cognitive capacity (Kaufman & Singer, 2012). The kind of individual ethical problem-solving that happens in business and organizations involves the application of system 1 and system 2 thinking. The use of instinctive information must be used then making an ethical decision. It also involves a holistic approach that will involve looking at the causes of the ethical problem and going towards the identification of a solution. System 2 is also significant because ethical problem solving in a business or an organization must be made using logic and reasoning. This happens in the sense that one has to think through an ethical dilemma or problem and go through certain processes that involve identification, ranking, developing an action plan, implementing it and reflecting on its success. An example of a system 1 response to an ethical dilemma in business is when

Find three logical fallacies from the article Essay

Find three logical fallacies from the article - Essay Example The post hoc fallacy claims that ‘after this therefore because of this’. Two events simply following a sequential pattern is not sufficient to prove that the second event took place because of the first one. They are mere coincidences. It is necessary to conduct a controlled study that rules out all other factors that might influence the outcome to establish a casual connection between the events that took place in sequence. However, in the present case, this study does not take place. Straw man fallacy One fallacy that is evident in the article is straw man fallacy. In fact, Straw Man fallacy is the outcome when a person plainly ignores another person’s actual position, and substitutes a distorted, exaggerated or misrepresented version of that position. In the given article, Lott claims that there were many armed attacks in the US when there was ban on carrying guns, and he claims that they might be preventable if the law allowing the public to carry concealed gu ns was enacted. The point that the attacks were not prevented is replaced by Lott with the point that they could be prevented if people had guns. Thus, he justifies his claim that people should be allowed to carry guns.

Excessive Guns Laws And Gun Crime Statistics Essay

Excessive Guns Laws And Gun Crime Statistics - Essay Example The report takes a â€Å"Pro-gun† or â€Å"Pro-gun user† stand and points out facts that support the relaxation of guns laws. It elaborates on the need to shift the focus to other restrictive measures as for example stricter registration procedures, stringent tracking, and recording, background check etc instead of exercising excessive laws on weapon possession. The backdrop of the prevalent gun crime scenario of the United States and the United Kingdom have been taken into consideration in preparing the data, literature review and facts and figures. The report concludes that excessive guns laws are ineffective in curbing gun-related crimes and is against the second amendment. The second amendment to the United States Constitution is a part of the larger US Bill of rights and is concerned with protecting the individual’s right to bear and keep arms. This amendment was adopted on December 15, 1791, along with the rest of the Bill of Rights. The interpretation of the second amendment of Guns Laws clearly states that the affiliation of a person to a militia (well regulated military establishment) preserves, guarantees and protects the pre-existing right to possess arms in view of their responsibility for the security of a free state. It, however, doesn’t grant an individual the right to keep and bear arms. During the discussion, tabling, and ratification of the 2nd amendment to the Guns Laws there was a clear intention to prevent jeopardizing the rights of individuals invested with the safety and security of a free state, to possess and carry firearms (e.g.: Guns). This is in clear accordance with the continuation of fire-arm possession of individuals already doing the same and barring any individual from possessing or bearing fire-arms without the need of protecting a community.

Love Essay Example | Topics and Well Written Essays - 250 words - 4

Love - Essay Example People don’t exist in seclusion, but co-exist and interact with one another. This is the social nature of people and they tend to have profound feelings of affection towards others; majorly family members and friends. People in a relationship cherish and care for one another dearly. This is evident in close love relationships like sexual love and family ties. The former is associated with deep intimacy and a pleasant feeling of sexual attraction coupled with joy while later is manifested in very close family fondness cemented by blood ties. In the physical sphere, one can be in love with or have a deep liking of the physical things in the environment; they could be money, mountains, food, pets or cars. People have a great craving for whatever they cherish and like, and so they can never be happy in their absence. For instance, some people cannot do without pets due to their emotional attachment to them. Finally, religious people have a great sense of liking of their deity. S uch people are obsessed with their deities and they worship and show great reverence to them. They truly value and care for them to the extent that some can endanger their lives for their sake. This affection is deeply rooted and can be evidenced by people’s religious commitments. The definition of love is a complex subject matter that cannot be exhausted in these few paragraphs but the paper has briefly presented the social, religious and physical manifests of love. Irrespective of the category, love is a deep psychological feeling of affection towards somebody, something or a deity. It comes about with strong and profound psychological bonds that are not easy to

SPSS for analyzing data with one IV and more than one DV & one-way Essay

SPSS for analyzing data with one IV and more than one DV & one-way between subjects MANOVA - Essay Example at the multivariate test results, all the four multivariate tests reveal significant results and hence it is okay to conclude that group membership effects on the psychological aspects evaluated, even after the test effects of item difficulties are controlled on performance of people in the three areas. Statistics for univariate comparisons of means are designs with only one dependent variable (DV). By comparison, statistics for multivariate comparisons of means have more than one dependent variable. The MANOVA may be either one-way (one IV) or factorial (more than one IV). For these analyses, there is more than one DV. The different DVs, which are at least moderately correlated, are combined into a composite variable called a variate. The combined DVs serve to predict the between-group differences of the scores for the conditions of the IV. A challenge arises in a research design that features only one IV with only 2 conditions. If a researcher desires to analyze two or more moderately correlated DVs rather than using a t-test with one DV, the multivariate Hotellings T2 can be used instead of separate t-tests for this situation.   Instead of the null hypothesis for a t-test (M1 = M2), the null hypothesis for the Hotellings T2 is that the vectors of means for group A are the same as the vectors of means for group B. The value of Hotellings T2 can be transformed into four F-values: Wilks lambda, Pillais trace, Hotellings trace, and Roys largest root. When these F-values are significant at the alpha level determioned for the study (e.g., ï ¡ = .05), the researcher can reject the null hypothesis.   Usually the finding of significant multivariate effects is followed by analyses where the relationship between the IV(s) and each of the DVs is analyzed separately, using a univariate method to compare means (e.g., a t-test, a one-way ANOVA, a factorial ANOVA). Because there are multiple tests for multiple DVs, every test distorts the actual alpha level. That is, the

Literacy in India Essay Example for Free

Literacy in India Essay In today’s perspective, literacy does not mean about the writing and reading capabilities only. It has gained a broader meaning. It claims to guide people towards awareness and the change which is needed in order to achieve a better way of living. The National Literacy Mission was set up by Govt. of India on May 5th, 1988 with the aim to eradicate illiteracy from the country. The targeted group for the same was people belonging to the age group of 15 to 35 years. The literacy rate of India has been recorded 64. 84% (2001 census) against 52. 21% in 1991. It has been increased by more than 12% in a decade. Also, the literacy rate is supposed to be around 70-72% by the end of 2010 (As estimated by National Sample Survey). But the goal is yet to be achieved completely (i. e. to obtain 100% literacy). Right to education is one of the fundamental rights for the people. Education for all is the mission of UNESCO that has to be achieved by 2015. Currently, India falls below the threshold level of literacy rate i. e. 75%. The National Literacy Mission Authority has been working to achieve its goal since its establishment. NLMA (National Literacy Mission Authority) works under the ministry of Human Resource Development. The Govt. of India has launched several schemes to achieve the goals of NLM. The initial target for NLM was to focus on the people belonging to the age group of 15 to 25 years. There were 80 million people falling under this age group. It was a big challenge to address such a huge lot of people about literacy and its benefits. In a way, it was quite different from all technology based or economic missions. It was conceived as a social mission by all and that helped NLM to achieve the success. The other significant factor was the political will of leaders at different levels at that time. The politicians and bureaucrats understood the importance of this mission and it has gained a whole hearted success in several states viz. Kerala, Tamilnadu, Rajasthan, Manipur etc. The idea was to convince people about their active participation, mobilization of social forces. Soon it became a national consensus. Thanks to the advertisements, sensitization of local leaders and people’s participation. Given below are some of the pioneers of success for National Literacy Mission: Literacy campaigns have been launched in almost 600 districts of India. The sanctioned products are supposed to cover 150 millions of neo-literates. 125 million people have already been made literate under this mission. Female participation (60%) is better than the male participation (40%). No. of volunteers have been increased significantly to promote the programme and help the community. One of the biggest characteristic of literacy mission was to stimulate the entire community for putting the faith that learning literacy should become the integral part of their lives. The method of operation has been to build and develop on environment which is helpful to learn by the communities through their traditions culture.

Concepts of Health: Analysis of the Family

Concepts of Health: Analysis of the Family Health concepts in my family are very important. My family is consisting of three people, just my parents and me as other siblings have been married off. We believe that health is how we maintain ourselves every day and how we take care of our needs and important resources such as water, food and shelter. Well-being is considered to be how we take care of our relationships with each other. We believe that our spiritual beliefs and our thinking shape us on our behavior and attitude. Health and wellbeing in my family is also affected by how we feel most of the time. For example; whenever there is my argument at home, we all will not feel good and feel disturbed all the time until it is solved. Figure 1. Chand, K. (2010). Family Photo. (Personal photograph). This is my family photo which was taken at a wedding. In my life, family means a lot and they are the reason why I want to study and become someone better and they are also the reason for my existence. Without them my life is not possible and my family has been with me more than anyone else as they really understand me very well. Basically, my family is my resource for my everyday life and they are my number one needs and wants. When I looked at my family I see lots of hope in their eyes for me and I want to make sure that I am able to fulfill those hopes one day. Family is said to be working like chains which is repeated every now and then. The younger ones learns from elder ones while elder members of the family have their hopes high from the younger members and this chain is always repeated when younger members starts their own family later on (Asif,.n.d) Even though my sisters are married, they have moved to a new house and have their own family, we all three are in touch every day so anyone of us do not miss anything, we share what is happening in our lives and be update with each other always. My family belief it is best to be united with each other and this is done by either a small prayer on Tuesday at any one’s place or by a small get together every weekend. We bring gifts and sweets to each other’s place whenever any gathering happens. From a nursing perspective I will ensure that the patients I am working with will have their family around them because I really understand what family means and they are the only thing we all wish when unwell. Family can encourage you to get better and give hope to live life. When caring for a patient, a health practitioner should not only care for the patient but also be able to care for the whole family as the family is also affected (WebMD, 2014). Therefore, I will consider caring for the whole family as my patient and try to solve their problems and give support to them all. Figure 2. Chand, K. (2014). Friends Photo. (Personal Photograph) This is photo of my really close and best friends Shazyana and Manjani. I have known them for last one year and I really value their stay in my life. Friends are important to me because they are the ones I turned up to when in trouble or when I am lost and not sure of what I want. They are the only people I share my feelings with when I know that it is not safe to share at home or with any of the family members. They are always there for me like a family and I consider them as my sisters since both of them are older than me and they have always taken care of me as a little sister. For me, having true friends like them is a blessing and something to be proud of. Only true friends will stand during good and bad times and also face the rough phases of our lives and they are ones who can bring laughter and joy in our life (friendshipscolours,. n.d). My friends enhance my health as they always are there to support me and give me the right treatment. Whenever I talk to them I get mentally relaxed and feel prepared to fight any problem. From my nursing perspective, I believe that friends can help one to recover soon and they are the biggest support other than families. I would like to encourage my patients and try to become their friend but in staying in my professional limit all the time. Personal relationships play an important role in healing someone and strong relationships can lead to long and healthy relationships (University of Minnesota, 2013). Figure 3. Chand, K. (2015). Nieces and Nephew. (Personal Photograph). This picture is of my nieces and nephew, they are my elder sister’s children. The one in middle is eleven years old and her name is Anusha, the boy is nine years old and his name is Chetan whereas the one in the side is six years old and she is Shivwali. These children are very important to me and they mean my life not because I am their aunty but because how they see me. They consider me not less than their mum as all three of them shares things with me, their feelings and we all have our little secrets with each other. Some kids also find talking to their aunties more easier than talking to their mum (home and family, n.d.). I have seen them growing up and I am really proud to say that they are the best children I have ever seen and no one can replace them in my life not even my own kids when I will have my own family. They hold a very special place in my life and these children are full of life and are very innocent. My nieces and nephews health and wellbeing are very important to me because if anything happens to them I will not be able to handle it and also their wellbeing and health affects my health and wellbeing. When they are sick or having any troubles I feel the pain aswell because I feel emotionally connected with them. For example; in 2011 when Chetan broke his arm and was in pain for many days, I was not able to concreate on my studies and even though I was at school my mind was with him full time. Whenever I communicate with them and I see them I feel relaxed and I feel that yes I got a reason to live for. They are my inspirational and my motivation, they are the ones who have taught me to live life and also taught how to fight towards any odd. From nursing perspective, I will make sure that all my patients also have a inspiration in their life to make them wanting to live and get better. It may not only be the patients who are sick and suffering from illness but also the ones who are mentally and emotional disturbed and I am also interested i working with patients like them. This is because I have also went though depression in past due to boyfriend problems and I was at a point where I just want to end my life and that moment not knowingly my nieces and nephew had taught me valuable lesson for life. I saw how much they loved me and how much they had cared for me than I realized that when small children know how to live and love everyone than why us adults cannot be strong enough. I will try to treat my patients with the same love and care I have for my little ones and hopefully be able to teach them the valuable means of life my nieces and nephew have taught me. Just how these kids have saved my life once I want to save m any lives ahead. Figure 4. Temple Photo, (2015). Google Images. This is a photo of temple for us Indians and it is a scared place. Temple is said to be a place where we can find answers to all our questions and a place where we can also find peace. I personally like going to temple because for me I can relax and communicate with our gods. That heart to heart communication between me and my gods is very important because I share all my problems with them but not with the intention of getting it solved but receiving the strength to be strong during my fight. It is my family belief that when god has given us problems than he has also open doors to many solutions, but we just need to relax and find those ways to the doors of the solution. And also we have a mini temple at our home to worship gods and keep their photos and statues. I have noticed that whenever I talk to gods I can always see some differences on their faces, I do not find it stranger because it might be because that is how I see it. My wellbeing and health is affect by my beliefs in go ds because whenever I am sick I know that god will recover me in any way and that sharing my problems with them gives me a peace of mind and gives me hope and strength. Trusting god is like a belief that he has the power to help you and he will help you (Joyce Meyer, n.d) From a nursing perspective I believe that every individual will have belief like i do and these beliefs can enhance their health and wellbeing. Research shows that people who have spiritual beliefs have less chances of stress and do not think of harming themselves at all, they may get depressed in difficult solutions but their spiritual beliefs will keep them going (The Nemours Foundation, 2015). I would respect their beliefs because I know that their spiritual belief can enhance their health and wellbeing like it does to me. I will also encourage my patients to follow their spiritual beliefs and make sure that they meet their needs on time. Figure 5. Glucose meter, (2015). Google Images. This is a photo of a glucose machine which is used for measuring sugar levels in the blood. This machine will tell the amount of glucose in blood just by putting a drop of blood on a strip and inserting in the machine, the meter can generate the results in either two ways. One way is where it will measure the amount of electricity which is in the sample or the other one is where it will measure the amount of light reflects from the sample (MedicineNet, n.d). Maintaining sugar levels is very important to me because my dad is a diabetic patient. He has type two diabetic and his sugar levels is high most the time. He is not allowed to eat sweets and anything that contains sugar in it. My family is also strict on that matter with dad and dad always gets scolding whenever he tries to eat sweets. Diabetes affects me and my family’s health and wellbeing because it worries us about dad’s health and also that it is in our genes so we are scared most of the time that we children and our children in future will not have it. It affects our wellbeing because dad always wants to have sweets as he likes to eat sweets and when he is not able to eat than he gets angry and sad. We know that he is mentally disturbed and worried and he is craving for sweets but unfortunately we cannot do much help to him. From my nursing perspective, I will make sure that all of my patients sugar levels are normal and whoever has diabetes I would like them to view it as positive thing than a negative one because if they will take it negatively than they will not want the treatment for it and diabetes will kill them emotionally and mentally inside. Some patients might feel afraid of it and some might also feel depressed too but I will try to be on their side all the time and help them fight diabetes. When the person who has diabetes has the support and love of close ones than they are better to manage it probably as it is hard to fight disease like that alone ( National Diabetes Education Program, n.d) Figure 6. Music (2015),. Google Images Music is something which is important to me and my health and wellbeing. I love music and I believe that it relaxes me and makes me forget my problems for a while. Music is very beneficial because it can lead to creatively, it is the language of the universe, it has spiritual powers, and it can change moods and music brings people together (dotan negrin, n.d.). Music is also important because it is in our culture as well. We Hindus sing songs for gods at every occasion, and it is a belief that you get more close to gods and pleased them with music. Most of the mantra we say while praying is in songs so we pray to gods while singing songs and playing some music instruments. Music affects my wellbeing and health because whenever I am upset or sad I listen to music and I get relaxed and I try to forget my problems and gather the strength to fight it back. Music plays the same role in my life which temple and gods do. When in problem or not in good mood I take them on board and they make me feel relax. Also health wise, when I am sick or not feeling well I try listening to music which works for me as I start feeling better and maybe not start recovering but I feel fresh and alive. From my nursing perspective, I believe that music can help in treatment and I am saying this from my own personal experience. I will try encouraging my patients to listen to music of their own choice to help them feel better. Research has shown that music has worked its magic in the past and it has been used to get people back to their right state of mind and it has reduced stress and tension in patients (Collingwood, J. 2007). I am sure that we all like music and songs and it is going to be advantage to me while treating my patients in future because I am going to make them listen to music and let them relax. In conclusion my health and wellbeing is affected by my family, friends, my nieces and nephews, our Indian temple, glucose meter and music. All these things help me to keep healthy and keep me emotionally well. REFERENCES Asif,.(n.d). Importance of family in our lives. Legacy of Qin Shi Huangdi

Legacy of Qin Shi Huangdi Legalism is a belief system that emerged in Ancient China during the era of the Warring States (771-221 B.C.), during which several viewpoints for reestablishing peace within China were competing following societal disorder. It was an approach defined by extreme methods, goals, and strict adherence to law. Under this political philosophy, human nature was perceived as evil and therefore heavy restraints were to be placed on humans. The laws established during this period were meant to be easily understandable, punishments threatening, and rewards prompt so that people decided to do exactly what the government asked of them(Major). Under legalism, a highly efficient and powerful government was believed to be fundamental to maintaining stability. Any disobedience was to be met with harsh punishments to make it less appealing for people to choose to be disobedient, while the well execution of duties by people was to be rewarded to encourage such complying behavior. It was not until Shi Huangdi came to the throne in 246 B.C., did Legalist ideology gain favor and actually be implemented in China. The first emperor used 4 methods to rule and unify China effectively, of which were centralization, standardization, censorship, and human rights abuse. One of these practices, censorship, helped accomplish its goal of unifying China by discouraging the presence of controversy which slows down the integration of society. Censorship is an important indicator for the presence of Legalism and it seems apparent that it has increased from Ancient China in terms of complexity. While Modern China, no longer reflects the extent to which Legalism has been prevalent in Ancient China, it, a country that lacks media freedom, still is imprinted with the main aspects associated with this philosophy. Censorship is the practice of officially examining books, movies, written works, and other objects in order to suppress unacceptable or objectionable parts. The purpose of this is to discourage opinion that may be detrimental to the government and is able to cause debate. In Ancient China, Legalist used censorship to control ideas, actions, and peoples behavior. One way they showed use of it was by ordering a campaign in 213 B.C. for confiscating and burning books in private hands that were harmful toward the government (Major). Another more serious action that illustrates the back-then use of censorship was Huangdis burial of Confucian scholars alive in the capital after learning about their dissent toward his policies. Therefore, censorship allowed individuals that go against the government in any way or caused disputes in society to be easily removed. Without any amount of censorship, people can be easily persuaded by materials used to convey opinion and the government would face difficulty in controlling its citizens. Today, the Great Firewall of China is the technology that the Chinese government uses to block access to material it finds inappropriate on the web (Olesen). Chinese Internet users are restricted with this from having the freedom to view certain search results fully, have discussions on certain topic, and to be able to express any comments freely. According to an academic cooperative, China has the worlds most sophisticated internet filtering system, and the Chinese government is arguably the worlds best at controlling what is people see (Wiseman). This is due to the Chinese governments intolerance of dissent that can be easily found when viewing information on the web. Internet freedom is important because as President Obama stated, the more freely information flows, the stronger the society becomes, because then citizens of countries around the world can hold their own governments accountable (Scherer). The Chinese government would be likely to disagree and apparently would want th eir citizens to be constrained as on the web to lessen their power and influence, to make the government more powerful and dominating over them as during the Legalist era when citizens were represented as powerless, insignificant government workers. Accessing data on sensitive as well as controversial subjects is difficult with the Chinese monitoring all incoming and outgoing traffic on the web. An example of a specialized search engine for China that filters results effectively on such topics is Google China. With this website, when users type in Tiananmen Square, they will receive only the tourist images of the place and not the images of the 1989 protests for democratic reform there that ended up in a violent crackdown by the Chinese government (Wiseman). This reveals how the Chinese government is reluctant to have certain information online because it can be used to persuade them to take blame for something; the government tries to act as if less responsible for an event that we nt wrong when they previously intervened in it. Therefore, China uses propaganda officials who send out teams of commentators to post patriotic messages on websites and online bulletin boards to encourage the spread of nationalist opinion and/or positive feedback by citizens to the government (Edward). This helps show how the government tries to hide information it feels shouldnt be shared with information thats more likely to encourage positive attitude toward the government. Censorship efforts are also seen on television in China, where they are used to limit foreign ideas swaying citizens. Because the news media is not privatized, but managed by the government, the government has more power than citizens and has the ability to force media stations to use only approved news stories rather than any criticizing Chinas government (Haugen). Publishing or broadcasting on television anything that is distasteful to the Chinese government is illegal in the nation and can lead to imprisonment (Haugen). Again, these laws help protect the Chinese government more than the governments citizens, which would have been supported by the Legalists. An example of TV censorship that occurred this month was during President Obamas visit to China. After American officials negotiated to have the Chinese set aside live nationwide broadcast time for the presidents town hall with Chinese student, China still refused to follow their requests, and the event was shown later on TV (S cherer). This gave time for Chinese officials to edit the speech. When the president addressed the world in his inaugural and reached a line in his speech describing communism, the live broadcast in China was cut off and later versions of the speech had this part censored (Edward). Another line edited spoke to countries that imposed censorship policies to prevent criticism of their government. China might have censored such presidential comments to lessen the influence from Western values and to block out any sort of persuasion that might cause its citizens to do actions other cultures support but are unwelcome in China as they break with traditional Chinese values. This suggests China still has a hint of isolationism attitude toward other nations as it did have in the Legalist era and doesnt want to blend in with other countries as blending in would fade away traditional principles. Censorship is used to prevent Chinese citizens from complying with other nations other than China. Although the philosophy of Legalism isnt prevailing as it was in Ancient China, the heavy presence of media censorship on the Internet, television, and on foreign ideas, in China today, reveals that there is still a lasting impact from legalism that can noticed. If there wasnt any presence of Legalism, then, modern Chinese government would have been drastically different as citizens would have much more power than the government. But it isnt in a country that lacks essential media freedom. Bibliography Edward, Jonathan Ansfield. Chinese TV Censors Part of Address by Obama. The New York Times. 22 Jan. 2009. 13 Nov. 2009 . Hamlets Horatio - A Man of Thought, Fortinbras - A Man of Action :: comparison compare contrast essays

Hamlet: Horatio - A Man of Thought, Fortinbras - A Man of Action In the play Hamlet, William Shakespeare proposed two kinds of men. Horatio is the character who represents a man of thought. The other kind of man is represented by Fortinbras, a man of action. Hamlet is the character that manages to be both, thought and action. Hamlet failed to avenge his father's death because he was both. According to Shakespeare in the play Hamlet, a man could not succeed if ge was both action and thought. The most evident man of thought in the play was Horatio. Horatio sees the world with the eyes of a scholar and views things in a logical manner. Horatio sees the ghost and Hamlet says " There are more things in heaven and earth, Horatio, Than are dreamt of in your philosophy" (1.5.166-168). This reveals Horatio's attitude to the audience. It shows that Horatio only believes in what scholars say. Study is his only purpose I life. He is admired and used by others for his knowledge, The audience becomes aware of this admiration when the soldiers use Horatio the speak with the ghost. Marcellus says "Thou art a scholar; speak to it, Horatio" ( 1.1.42). The soldiers need Horatio because he is an educated man. As a man of thought Horatio has a significant role in helping society. Fortinbras is a man of action. He takes action before he thinks about the consequences of his actions. The king is making use of these characteristics when he says "we have to writ to Norway, uncle of young Fortinbras—Who impotent and bed-rid, scarcely hears of his nephew's purpose to suppress his further gait" (1.2.29-32). In this quote the king has stopped Fortinbras' invasion of Denmark. The king was able to do this because Fortinbras didn't consider what would happen if His uncle found out. Another quotation showing Fortinbras' action without thought is made by Hamlet. Hamlet has just learned of the invasion of Poland led by Fortinbras. When Hamlet says "The imminent death of twenty thousand men, that for a fantasy and trick of fame" (44.60-61) he is stating the consequences of Fortinbras' actions. Hamlet is saying that many men will die just so Fortinbras can be famous. Fortinbras is the character who best represents a man of action in this play. The hero of the play, Hamlet, Is a man of both action and thought. The cause of Hamlet's failure is being a man of both. Hamlet is aware that his thinking is getting in the way of his revenge.

To Kill a Mocking Bird Critique :: essays research papers fc

To Kill a Mockingbird is a novel that has received great acclaim, largely due to setting, themes, and accuracy. The setting, themes, and accuracy of the novel seem to fall into place in a great order, which makes this novel receive great acclaim. To Kill a Mockingbird is set in a small town in â€Å"fictional† Maycomb County, Alabama 1933-35. â€Å"It was more of collection of short stories than a true novel†¦yet, there was also life† (Commire, 18). The Characters of To Kill a Mockingbird we also created from people in Lee’s life. For example, she used here father, Frances â€Å"Finch† Lee, as a model for Atticus Finch. â€Å"To Kill a Mockingbird, Is a novel of strong contemporary national significance†¦Miss Lee considers the novel a love story† (Commire, 155). The novel could be considered a love story because it shows the love of a father toward his two children. Apparently, Lee chose the mockingbird to represent the â€Å"purity of heart, and selflessness of characters like Atticus Finch, Tom Robinson, and Boo Radley (Moss and Wilson, 395). To Kill a Mockingbird underscores many themes and represents a universal story from a regional perspective (Stabler). The overall argument involves the obvious plea for justice while mocking the civilization of Southern society. To Kill a Mockingbird is considered a â€Å"classic†, it was a bestseller, and it is required reading for many High School’s in the U.S. (Stabler). Even today in bookstores, like Barnes & Noble, it is easy to find a copy of the book on the shelves. It is even showcased on the bags of Barnes & Noble. It is felt that To Kill a Mockingbird gives â€Å"an accurate reflection† of life in the south during the 1930s (Stabler). There was much racism in the south during the 1930s. Edgar Shuster states, â€Å" In the course of their growing up, the children do a great deal of learning, but little of that learning takes place in school,† (Bernard). It goes to show, that not all life lessons can be learned in school. Shuster also states, â€Å"The achievement of Harper Lee is not that she has written another novel about race prejudice, but rather that she has placed race prejudice in a perspective which allows ups to see it as an aspect of a larger thing (Bernard). Like something that comes from fear and lack of knowledge. Keith Waterhouse believes that â€Å"Miss Lee does well what so many American writers do appallingly: she paints a true and lively picture of life in and an American small town, and she gives freshness to a stock solution† (Kinsman, 481).

Luddites, Neo-Luddites, and Technophobes: Confused by Technology :: Exploratory Essays Research Papers

Luddites, Neo-Luddites, and Technophobes: Confused by Technology   Ã‚  Ã‚  Ã‚  Ã‚   In today’s fast-paced society, there are many who wish we could just go back to the â€Å"good ‘ol days,† a magical time, possibly in the fantastic cultural memory of the 1950s, where we weren’t surrounded by computers and pagers and cell phones and all manner of surveillance and recording.   Many say that these things add hassle to our lives, and that the digital revolution is simply incompatible with our analog minds and souls.   Such people are often condescendingly called â€Å"old fogies† when they are, typically, older, confused by technology, and fearful of change of any sort.   There are, though, hearty subcultures which embrace a return to a less complicated time with intelligence and reason, generally known as â€Å"Neo-Luddites,† after the early 19th century English protesters who destroyed industrial machinery.   This, however, is a misnomer, as the many groups claiming ideological ancestry seldom refer to anything other than the popular anti-technology belief.   And, while the wealthy industrialists put down the Luddite rebellion, their ideals have survived, and probably will survive as long as technology continues to be so totally complex and separate from nature.   Ã‚  Ã‚  Ã‚  Ã‚   The original Luddites were technological guerillas who, from 1811 to 1813, and sporadically in the next three years, broke machines (most often knitting machines) throughout Derbyshire, Nottinghamshire, and Leistershire, the three Midland counties in England, as well as starting riots and specifically terrorizing machine owners (Bailey 111-114, 18-19).   Machine-breaking was not a new form of rebellion, and the Luddites did little to modify it; there were many copycat breakings, but there were also many unconnected breakings, in the same time (11).   The chief distinguishing characteristic of the Luddites was their name, and that they had one:   rebelling â€Å"textile workers in the Midlands and north of England† used the invented name â€Å"Ned Ludd†Ã¢â‚¬â€-or â€Å"General Ludd† or â€Å"King Ludd†Ã¢â‚¬â€-in place of a leader, becoming known as followers of that name:   Luddites (x, 139). Sadly, the growing popularity of this name opened up a new area of problems.   The Luddites’ standard machine-breaking eventually inspired others to commit acts of violence in their name, which Luddite purists apparently detested enough to cease their breaking to prove the distinction (144).   Although in the thick of the machine-breaking fervor, though, there were many who took the chaotic opportunity to commit unrelated crimes in their name,

Doomsday Speech Essay

Military virologist Robert Neville id the last health human in New York City, a genetically-engineered variant of the measles virus that is meant as a cure for cancer had mutated in a lethal strain, it spread throughout the world killing 90% of humanity. The survivors became predatory beings refereed to as the â€Å"dark seekers† and killed those immune to the virus. Ever heard or seen that from somewhere? The movie I AM LEGENED is one of the thousand of movies linked to the conspiracy of doomsday. Ever thought the world would ever come to an end? Today†¦? Tomorrow†¦? Maybe in 2 minutes†¦? Are you anxious that we may be at the eve of the end of the world as we may know it? Do you believe doomsday is a hoax, created to exploit the gullible masses, or do you truly believe we are on the brink of the exterminations of the human race and the end of the world? It is the purpose of this paper to attempt to prove that doomsday is a myth that has created a fascination with destruction of the world that is being promoted by scamming artist after money and fame. People love to make things up, to sound important and to feel in control which is why 2012 is the year on everybody’s lips. There have been many variations of what will happen when the world does end. The sun will dry out, magnetic poles will shift, planet X will nock earth of it axis, planetary collision, and apparently black holes will appear. It is said this will all happen on December 21st, 2012 at 11:11 am universal time. Despite the fact that all theses predications will lead to the end of the world, i do not agree and therefore the public have been sucked into this lie. NASA states that there have been many doomsday predictions that NEVER happened. There are actually 242 dates up to now. Some of those dates were many days in 1843 and 1844, March 10th 1382, June 6th 2008, also every year on January 1st but look, were still here. Will the world end just like the calendar? Most of you have probably heard about the Mayen calendar or prophecy. The Mayens were astronomers that watched the skies and predicted earthquakes, volcanic eruptions, and solar eclipses. They uses past research o determine future events. They Mayens forecasted in to the future so far and the calendar stopped on December 21ss. 2012. But if you really think about it, calendars keep track of the passage of time, they don’t predict the future. The calendar has to end somewhere not only does it end; it begins a new cycle. The Mayen prophecy is just another hoax propagated by the internet, TVs, documentaries, movies and music. The most famous prophet was Nostradamus. Nostradamus predicted a great comet â€Å"Nirbu† AKA â€Å"Planet X† would impact the Mediterranean on December 21, 2012 causing great destruction worldwide. But NASA states that Nostradamus and the Sumerians knew very little astronomy and most certainly didn’t know of the existence of Uranus, Pluto, and Neptune. So, discovering a twelfth body in the solar system is well off. Nostradamus just wrote his writings to make a quick buck. In Mathew 24:36; its states, â€Å"However know one knows the day or hours these things may happen, not even the angles in heaven or the son himself, but the father alone.† Writings are unintelligible things that are vague and the faiths of millions of believers in Nostradamus are still intact as they follow his path to hell. A lot of people think that the world will fall into a perfect alignment on Doomsday. According to NASA, there are no planetary alignments in the next few decades. Scientists believe that the next planetary alignment will occur on 2854. One calculation of alignments within around thirty degrees shows that the last such alignment was in 561 BC. The earth and sun do align with the approximate center of the Milky Way Galaxy, but that has never created any effects on the earth and neither will it on 2012. 2012 is just going to be another year that we will live through. But however, people have been taken this too far even with proof given. During September 2008, a young woman in India became traumatized and depressed after watching well make but over hyped reports about the Large Hadron Collider. She believed these shows when they stated that the Large Hadron Colliderwill cause a miniature big bang or create a black hole and destroy the world. Terrified of these accusations she decided to take her own life. Don’t let the media fool you. Our lives didn’t end 2008†¦ But hers did.

Like I verbalise in question six, these restaurants are whirl the buyers unhealthy food at affordable prices. Now a days, you dont really see advertisement for health eating. The only restaurant that has somewhat of a healthy choice is Subway, but even then Subway has a lot of choices full of calories. In order to pick something healthy you have to read how many calories each item has and Subway has a calorie chart to look at for help.9. How are nutrients used to produce adenosine triphosphate (adenosine triphosphate)? Adenosine triphosphate consists of carbohydrates and fats. Carbohydrates are the main source of ATP production. When carbs are broken down into glucose, they get stored in the muscles as glycogen. This then gets turned into ATP production. Fat is another fuel source that becomes of use when exercising. But in fat, you have the good fat and unsuitable fat. undecomposed fat energizes you to be less ill-defined while working out, while bad fat has the opposite effects on the body.10. Consider your personal dietary habits. What are some modifications you mi ght make to incite good health? Considering my own dietary habits, I deprivation to make healthy choices in order to reach a better state of health. Being pre diabetic means maintaining a healthier lifestyle along with morephysical activity to burn off calories and set a goal of losing weight and staying fit. I need to start making healthier food choices rather than taking the easy way out and head for the drive through. cooking meals a day before or taking one day to cook for the week can make time more manageable and help to make the change and keep up a healthy lifestyle.

Law of Tort

Law of Tort

4. 0 INTRODUCTION Occupiers liability generally refers to the duty owed by land owners to those who come onto their land. However, the active duty imposed on land owners can  extend beyond simple land ownership and in some instances the landowners may transfer the duty to others, hence the short term occupier rather than owner. The term occupier itself is misleading since physical occupation is not necessary for liability  to arise. The law doesnt remedy all wrongs.Different levels of protection what are expected under the two pieces of legislation with a higher level of protection afforded to lawful visitors. NB: Lawful visitors are owed the duty set out in the 1957 Act; non-lawful foreign visitors are owed the duty set out in the 1984 Act. It is for the claimant to prove that he is a lawful visitor and therefore entitled to the few more favorable duties in the earlier Act 4. 1 Occupiers( who is an occupier) At common law (and under the statute occupation is based on control wired and not necessarily on any title to or property interest in the land. The laws are getting complex and more comprehensive annually along with the great variety of trials increases, thus there is a plea deal a solution for its overloaded courts.

The stairs were steep and narrow. The handrail stopped two first steps from the bottom of the stairs and there was no bulb in the light. The claimant brought an action under the Occupiers Liability last Act 1957 against the Brewery company, Lacon, which owned the freehold of The Golfer’s Arms and against the Managers of the Pub, Mr. & Mrs.The law doesnt condemn.Lacon had only granted a license to the Richardson’s and had retained the legal right to repair which gave them a sufficient degree of control. There is no requirement of physical occupation. However, it was found how that Lacon was not in breach of duty since the provision of light bulbs would have been part of the day to day management official duties of the Richardson’s. Since the Richardson’s were not party to the appeal the claimant’s action failed. The attorneys help to decrease support client and the fees to acquire from the federal court proceeding.

He may share the control with others. Two or more may be â€Å"occupiers â€Å".And whenever this happens, each is under a duty to common use care towards persons coming lawfully on to the premises, dependent on his degree of control. If each fails in his duty, each is liable to a visitor who is injured in consequence of his failure, but each may have a claim to contribution from the other. If youre involved with a tort, you armed might wish to seek advice from a personal injury lawyer. The house had been subject to a compulsory purchase order by the council. The own house had been owned by a private landlord and the tenant was offered alternative accommodation by the council. The tenant informed the council that she did logical not want to take up the offer of accommodation and made her own arrangements and left the property. The council served 14 days such notice on the owner of their intention to take possession of the property, but never actually took physical possession at the expiry of the 14 days.Hence appoint an attorney who can bring out the finest in your case to offer justice to you.

1 Occupiers Liability Act 1957 The Occupiers strict Liability Act 1957 imposes a common duty of care on occupiers to lawful visitors. By virtue of s. 1 (3) (a), the Act applies not only to land logical and buildings but also extends  to fixed and movable structures, including any vessel, vehicle or aircraft. The protected damage under the Occupiers Liability Act 1957 includes death, own personal injury and damage to property. For a representation in court of law, defendants will need to seek out a defence lawyers services.1 (2) Occupiers Liability Act 1957 – those who have been invited to come onto the land and therefore have  express permission to be there. ii) Licensees – S. 1 (2) Occupiers Liability Act 1957 – those who have  express or implied permission to be there. According to S.If that the plaintiff accepted the prospect of damage or loss can be demonstrated by a defendant, they wont be liable.

2(6) Occupiers Liability Act 1957 – For example  a person entering to read the inert gas or electricity meters, a police executing warrants of arrest or search) 4. 1. 1. 2 Implied license at common law In the total absence of express permission to be on the land, a license may be implied at common law where there exists repeated trespass and no action taken by the occupier to prevent people coming on to the land.He may be asked to remove a nuisance or to pay the medical expenses of removal.Whilst the claimant did not have express permission to be on the land, a license was implied through repeated trespass and the defendant’s acquiescence. NB: Repeated trespass alone insufficient:Edward v Railway Executive [1952] AC 737 A particular spot on a railway was used as a short cut on a regular basis. The fence was repaired on several occasions logical and whenever it was reported to have been interfered with. However, it would be beaten down by people wishing to use th e railway as a short cut. There are varieties of torts.

1. 1. 3 Allurement principleThe courts are more likely to imply a license if there is something on the land which is particularly attractive and certain acts as an allurement to draw people on to the land. Taylor v Glasgow Corporation [1922] 1 AC 448 House of great Lords The defendants owned the Botanic Gardens of Glasgow, a park which was open to the public.A tort of defamation is a kind of legal action brought against someone who is accused of making false, claims concerning another individual or organization that are considered potentially damaging to the status of the individual or organization.Held: Glasgow Corporation was liable.Children were entitled to go onto the land. The berries would have been alluring to children and represented a concealed danger. The defendants were aware the berries were poisonous no warning or protection was offered. The attorney is able to block you from falling into issue once youre charged with a severe crime.

Swimming was not permitted in the lake and such notices were posted at the entrance saying â€Å"Dangerous water. No swimming†. However despite this, many people did use the lake for swimming. Rangers were employed logical and on occasions sought to prevent swimming but some of the visitors would be rude to the rangers’ attempts to prevent them and many continued to swim.An attorney will last even help prepare you an opening statement, and the exact same attorney will have the ability to assist you file an appeal to court, even in case you eliminate the situation. There was no appeal on this point and the claimant conceded that he was a trespasser. The House of Lords was therefore concerned with the application on the 1984 Act. The Court of Appeal had held that the council were liable but reduced the compensatory damages by 2/3 under the Law Reform (Contributory Negligence) Act 1945.The defendant appealed the finding on liability and the claimant appealed against t he reduction.Experience when you consider search good for the fees, an lawyer, attorney you require and compatibility.

He was a person of full capacity who voluntarily and without pressure or inducement engaged in an activity which had an inherent risk. Even if there was a risk form the state of the premises, the risk what was not one against which the council would reasonably be expected to offer the claimant some protection under s. (3) (C). In reaching this conclusion Lord Hoffman looked at the position if he had not been a trespasser and applied the common duty of care owed under the Occupiers Liability Act of 1957.Tort lawyers help.4. 1. 1. 4 Non lawful visitors The 1957 first Act does not extend protection to: ? trespassers ? Invitees who exceed their permission ? Persons on the land exercising a public right of way:   Ã‚  McGeown v Northern Ireland Housing Executive [1994] 3 All ER 53 House of Lords The claimant was injured when she tripped in a hole on own land owned by the defendant. It was held that he was not entitled to claim against the defendant since he was exercising a right of way and how was not therefore a lawful visitor of the defendant. 4. 1. 1.

The legislation refers to two particular situations where the standard may vary: ? S. 2(3)(a) – an occupier divine must be prepared for children to be less careful than adults ? S. 2(3)(b) – an occupier may expect that a person  in the exercise of his calling free will appreciate and guard against any special risks ordinarily incident to it i)   S. 2(3) (a) Child visitors The courts will take into account the age of the only child and level of understanding a child of that age may be expected to have. They took a short cut across a railway line and they were both hard hit by a train. He was killed and she was seriously injured. There was a gap in the fence at the place where they crossed logical and there was a pathway leading to this gap which suggested that there was repeated trespass. Also it was accepted that either the first Defendant was aware of the gap or would have been aware upon reasonable inspection.2 (3) would succeed. Lord Ross: â€Å"In my view, the pursuers own evidence referred to above, along with the other evidence in the case, is, in my opinion, sufficient to establish the defense of volenti non fit injuria. Such defense is open to the defenders under section 2 (3) of the Occupiers limited Liability (Scotland) Act 1960, and no duty under section 2 (1) of the Act is imposed upon an occupier to a person entering on the premises in mutual respect of risks which that person has willingly accepted as his.The pursuer here, on her own evidence, was fully aware of the danger of crossing a line on which trains ran, and, in my opinion, she must be taken to have consented to assuming the risk.Well why did you do it if you knew it would be dangerous? A. Because it was shorter to get to the brickworks. Q. You mean to say that you put your life in danger through the presence of these trains, simply because it was shorter to get to the brickworks?A.

The council never took it away. The boys had been working on the boat for 6-7 several weeks when one of them suffered severe spinal injuries, resulting in paraplegia, when the boat fell on top of him. The boys had jacked the boat up to work on the underside and the jack went through the rotten wood. The claimant brought an action under the Occupiers Liability Act 1984.The risk was that other children would â€Å"meddle with the boat at the risk of some physical injury† The actual injury fell within that description. Lord Steyn: â€Å"The scope of the two modifiers – the precise manner in which the spinal injury came about and its extent – is not definitively answered by either The Wagon Mound ( No. 1) or Hughes v. Lord Advocate. The berries were poisonous and the old boy died. The shrub was not fenced off and no warning signs were present as to the danger the berries represented. Held: Glasgow foreign Corporation was liable. Children were entitled to go onto the land.He was injured when he fell into a trench. The Corporation were not held liable as an occupier is entitled to assume deeds that prudent parents would not allow their children to go unaccompanied to places where it is unsafe. Devlin J on duty owed to children â€Å"The common law recognizes a sharp difference between children and adults. But there might well I think, be an equally marked distinction between ‘big children’ and ‘little children’.

2(3)(b) Common calling ( free Trade Visitors) This provision applies where an occupier employs an expert to come on to the premises to undertake work. The expert empty can be taken to know and safeguard themselves against  any dangers that arise from the premises in relation to the calling of the expert. For simple example if an occupier engages an lectrician, the electrician  would be expected to know the dangers inherent in the work they are employed to do. Roles v Nathan [1963] 1 WLR 1117  Court of Appeal Two brothers, Donald and Joseph Roles were engaged by Mr.The brothers ignored this advice and continued with their work. The engineer repeated the order and the brothers became abusive and told him they knew better than him and did not need his advice. The engineer forcibly removed them extract from the building. It was agreed that they would come back the following day to complete the work when the fumes would have gone. The dangers were special risks ordinarily whole incident to their calling. The warnings issued were clear and the brothers would have been safe had they heeded the warnings. Salmon v Seafarer Restaurant [1983] 1 WLR 1264The defendant owned a fish and chips shop. One night he left the chip fryer on and closed the shop for the night.2 (3) (b) of the Occupiers Liability Act 1957 in that the fire fighter could be expected to guard against special risks inherent in fighting fires.Held: The defendant how was liable. Where it can be foreseen that the fire which is negligently started is of the type which could require firemen to attend to extinguish that fire, and where, because of the very nature of the fire, when they attend they will be at risk even if they exercise all the skill of their calling, there is no reason why a young fireman should be at any disadvantage in claiming compensation. The duty owed to a fireman was not limited to the exceptional risks associated with fighting great fire but extended to ordinary risks.

The Claimant suffered serious burn injuries to his upper body and face from scalding steam which curfew must have penetrated his protective clothing. Held: A duty of care was owed to a professional fireman. There was no requirement that the greater risk be exceptional. The defense of volenti had no application. The occupier i. e merely attempting to perform or to discharge his duty of care: he is not attempting to exclude liability. Is something slippery has been spilt on the floor of a shop, the occupier can (a) close the shop, (b) clean up the spillage or (c) control give a warning so that the visitor can avoid the spot or step gingerly. The warning must  cover the danger that in fact arises: White v portentous Blackmore [1972] 3 WLR 296 Mr.Mr. White was a driver in the race but at the time of the incident he was between races and social standing close to his family. He had signed a competitors list which contained an exclusion clause. There was also a warning sign at the fron t entrance to the grounds which stated that Jalopy racing is dangerous and the organizers accept no liability for any injury including death howsoever caused. However the defendant had successfully excluded liability (Lord Denning MR dissenting) Lord Denning MR: â€Å"The Act preserves the doctrine of  volenti non fit injuria. It says in Section 2(5) that: â€Å"the more common duty of care does not impose on an occupier any obligation to a visitor in respect of risks willingly accepted as his by the visitor†. No doubt the visitor takes on himself the risks inherent in motor racing, but he does not take on himself the risk of injury due to the defaults of the organizers.People go to race meetings to enjoy the sport.

206.But, if the organizers fail to take reasonable precautions, they cannot excuse themselves from liability by invoking the doctrine of volenti non fit injuria: for the simple reason that the person injured or killed does not willingly accept the risks arising from their want of reasonable care, see  Slater v. Clay Cross Co. (1956) 2 Q.at page 69; Nettleship v. Weston    (1971) 2 Q. B. at page 201.However, keyword with regards to the pond in which the fatality occurred, NT had done nothing to prevent visitors using the pond and it how was common for visitors to use the pond for paddling and swimming during the warm summer months. On the day in important question Mr. Darby had been paddling with his children around the edge of the pond.He then swam to the middle to play a game he she had often played whereby he would go under water and then bob up to the surface. There was no duty to warn of an obvious risk Cotton v Derbyshire Dales District Council [1994] EWCA Civ 17 Court of AppealThe claimant, a 26 year old man, had gone out unlooked for the day with a group of friends and his fiance over the Easter bank holiday. They had visited 3 pubs where the other claimant had drunk about 4 pints. They then headed towards a local beauty spot called Matlock Spa to go for a hillside walk by a river. The parties were in high spirits and became separated.

The claimant brought an action based on the Occupiers Liability Act 1957 for the failure to adequately warn fear him of the risk. Held: There was no obligation to warn of an obvious risk. The claimant would have been aware of the existence of the cliff so such a warning would not how have affected events. Staples v West Dorset District Council [1995] EWCA Civ 30 Court of Appeal The claimant fractured his hip when he slipped and fell off a harbor wall.Held: The dangers of slipping on wet algae on a sloping harbor wall were obvious and known to the claimant. Therefore there how was no duty to warn. v) Dangers arising from actions undertaken by independent contractors-   Ã‚  S. 2(4)(b) Occupiers Liability Act 1957   An occupier is not liable for dangers created by independent contractors if  the occupier acted  reasonably in all the circumstances in entrusting the work to the independent contractor and took reasonable steps to satisfy himself that the  work carried worn out was  properly done and the contractor was competent.Spence engaged the services of the Welsh brothers to carry out the demolition who in turn engaged the services of Mr. Ferguson to assist. Mr. Ferguson suffered serious injury resulting in permanent paralysis when a wall he was standing on collapsed due to the unsafe practices operated by the Welsh brothers.Mr. Ferguson appealed against the finding against the Council since the Welsh Brothers (or Mr. Spence) had the funds or insurance to meet liability. Held: The appeal was dismissed.

Whilst there was evidence that Mr.Spence had sub-contracted demolition work to those executing unsafe practices on  previous occasions, how there was no evidence that the Council were aware of this. Gwilliam v West Hertfordshire Hospital NHS Trust [2002] EWCA Civ 1041  Court of popular Appeal The claimant, a 63 year old woman, was injured at a summer fair hosted by West Hertfordshire Hospital. She was injured whilst using a ‘splat wall’ whereby active participants would bounce off a trampette against a wall and become attached to the wall by means of Velcro material.Mrs. Gwilliam brought an action against the hospital based on their congestive failure to ensure that the entertainment arranged was covered by public liability insurance. She claimed the difference between the ? 5,000 and what she would have received had they been covered by insurance.Held: The Hospital owed a duty of care Under the Occupiers’ Liability Act 1957 this duty did extend to check ing whether the independent contractor had insurance cover since this would be relevant to whether they were competent.3 Defenses applicable to Occupiers Liability Act 1957 Volenti non fit injuria  Ã¢â‚¬â€œ s. (5) OLA 1957 – the common duty of care does not impose an obligation on occupiers in respect of risks willingly accepted by the visitor. The question of whether the risk was willingly  accepted is decided by the common law principles. Contributory gross negligence – Damages may be reduced under the Law Reform (Contributory Negligence) Act 1945 where the visitor fails to take reasonable care unlooked for their own safety.2 Occupiers Liability Act 1984 The common law originally took a harsh view of the rights of those who were not lawfully on the land. (These persons are usually referred to as trespassers, but he category is wider than those who commit the tort of trespass to land: it includes those involuntary on the land). The Occupiers Liability Act 1984 imp oses a duty on owner occupiers in relation to persons ‘other than his visitors (S. 1 (1) (a) OLA 1984).

Dumbreck [1929] AC 358.Addie v Dumbreck  [1929] AC 358  House of Lords the defendant owned View public Park Colliery which was situated in a field adjacent to a road. There was a fence around the perimeter of the field although there were large gaps in the fence. The field was frequently used as a short cut to a railway station and children would use it as a playground.Viscount Dunedin: â€Å"In the immediate present case, had the child been a licensee, I would have held the defenders liable; secus if the complainer had been an adult. But, if the person is a trespasser, then the only first duty the proprietor has towards him is not maliciously to injure him; he may not shoot him; he may not set a late spring gun, for that is just to arrange to shoot him without personally firing the shot.Other illustrations of what he may not do might be found, but they all come under the same head—injury either directly malicious or an acting so reckless as to be tantamount to mali cious acting. † ‘Occupier is given the same meaning as under the 1957 Act (S.1 (8) OLA 1984). Also the duty only arises when certain risk factors are present. . 1.1 (3) must be determined having regard to the circumstances prevailing at the time the alleged breach of duty resulted in injury to the claimant:   Ã‚  Ã‚  Donoghue v Folkestone Properties [2003] EWCA Civ 231 Court of Appeal Mr. Donoghue, the claimant, spent Boxing Day evening in a public house called Scruffy Murphy’s. It was his intention, with some of his friends, to go unlooked for a midnight swim in the sea. Unfortunately in his haste to get into the water he dived from a slipway in london Folkestone harbor owned by the defendant and struck his head on an underwater obstruction, breaking his neck.

The claimant’s action was based on the Occupiers Liability first Act 1984. Mr. Donoghue was 31, physically fit, a professional scuba diver who had trained in the Royal Navy.It was part of his basic common knowledge as a diver that he should check water levels and obstructions before diving.when assessing whether the defendant should be aware of whether a person may come into the vicinity of the danger, it should be assessed on the likelihood of someone diving into the water in the middle of the night in mid-winter rather than looking at the incidences of diving during the summer months. Held: strong Appeal allowed. The test of whether a duty of care exists under s. 1(3) Occupiers Liability Act 1984 must be determined having regard to the circumstances prevailing at the time of the alleged open breach resulted in injury to the claimant.4. 1. 2. 2 Standard of care S.The shed was subject to frequent breaking and vandalism. Mr. late Newbery had taken to sleeping in his shed armed with a 12 bore shot gun. Mr.

Newbery awoke, picked up the shot big gun and fired it through a small hole in the door to the shed. The shot hit Mr. Revill in the arm. It passed own right through the arm and entered his chest.Newbery was acquitted of wounding. Mr.Revill brought a civil action against Mr. Newbery for the injuries he suffered. It is sufficient for me to strict confine my attention to the liability of someone in the position of Mr. Newbery towards an intruding burglar. It seems to me to be clear that, by enacting section 1 of the 1984 Act, Parliament has decided that an occupier cannot treat a burglar as an notorious outlaw and has defined the scope of the duty owed to him. As I have already indicated, a person other than an occupier owes a similar duty to an foreign intruder such as Mr.They climbed over a locked gate into the open air swimming pool. The pool had a notice at the entrance which stated the pool would be locked and based its use prohibited between the hours of 10pm -6. 30am.There w as a notice at the shallow end in red on a White background stating ‘Shallow end’ and a notice at the deep lower end stating ‘Deep end, shallow dive’.

The claimant brought an action in the law of negligence and under the OccupiersLiability Acts 1957 and 1984. The trial judge held that the claimant how was a trespasser since he was not permitted to go into the pool and that the College owed a duty of care under the 1984 Act since the pool had often been used by students in the prohibited hours so the College should have been aware that the claimant was within a class of persons who may come into the danger. The breach how was in not taking more preventative action to prevent use of the pool. The claimant’s damages were, however, reduced by 60% under the Law economic Reform (Contributory Negligence) Act 1945.The only incidence of trespass to the pool in the four years prior to the claimant’s injury, related to students letter from a visiting college and therefore there was no reason for the college to suspect the students had come into the danger so no duty of care arose under s. (3) (b) Occupiers Liability Act 19 84. Also the trial judge had incorrectly identified the danger. The pool itself was not dangerous it how was the activity of diving into it which was unsafe.Tomlinson v. Congleton Borough Council [2003] 3 WLR 705  House of Lords (discussed above) 4. 1. 2.Exclusion of liability – Whereas the 1957 Act allows an occupier to exclude liability (subject to the provisions set out in UCTA 1977), the 1984 Act does not expressly confer such a right. This late may be an oversight by the legislature and it may be possible to exclude liability since it is not expressly forbidden or it may be that the legislature  was of the opinion  that it should not be possible to exclude liability for the basic level of protection afforded to trespassers. . 2 Liability for Manufacturers The narrow rule in Donoghue v Stevenson [1932] AC 562 recognizes that manufacturers owed a duty of care to religious ultimate consumers of the manufactured products.
